PINETOWN- The family of a police officer arrested for murdering his mother hopes that the doctor's report that examined him will confirm that he is healthy enough to face trial.

The family members of Constable Lungisani "Mazambane" Xaba (48), believe that he is deceiving the court along with them because he has no mental disorder. 

Xaba appeared briefly at the Pinetown Magistrate's Court and was taken to a doctor to examine him as he had previously asked the court to diagnose his mental state.

Of course, he was taken to a doctor and sent back to Westville prison where he will serve from 2022. 

His case has been set for July 31 where the court will accept the doctor's report and it will be clear what should follow.

Ms. Andile Xaba, who is the sister of the defendant, accused her brother of delaying the start of the trial which they are looking forward to.

"We hope that the doctor will confirm what we have always said, that Lungisani is healthy. As someone who used to work with the law, he keeps trying ways to escape," explained Ms. Xaba.

She asked that if it is that his brother is not well, why does he smile and show happiness when he sees his concubine in the court, but he is silent when he looks at his family as if he doesn't know.

Xaba was denied bail. He has changed lawyers many times. He cries even when he is sick. He recently tried to force the court to read a handwritten letter he had written while in prison, but the case was dismissed.

When it came back, he immediately asked the court to allow him to undergo a psychiatric evaluation.

"We don't know what new things he will come up with when we go back to court because he always has new things that he comes up with in order to delay the case," said Ms. Xaba.

Xaba is accused of hitting his mother, Mrs Greta Xaba (81), who was living with a disability, with a nailed board.

The incident took place at the deceased's home in Kwa Dabeka, Clermont on May 6, 2022 and Xaba was arrested the next day.
